We look forward to demonstrating through discovery a simple fact: Epic’s Answer distorts settled facts and recycles arguments long laid to rest by the independent Carequality resolution. It does virtually nothing to address, much less dispute, Epic’s anticompetitive conduct. Once again, Epic is unfairly characterizing Particle Health as a security threat and alleging HIPAA violations, though no such violations have ever been identified and no such complaints have been filed. Though Carequality’s steering committee said Particle conducted robust due diligence and violated none of their rules, Epic continues to cling to a discredited version of long-past events. We are confident discovery will reveal a pattern of evidence that makes it plain that for Epic, patient privacy is a pretext, not a true motivation. As we always have, Particle Health remains focused on serving our customers and ultimately helping patients achieve better health outcomes. We look forward to the discovery process.

Very pleased at the outcome that came out last night in our anti-trust case against Epic. While a few of the claims didn't survive, Epic's motion to dismiss was DENIED on all 3 of the core monopolization antitrust claims. This is the first time in Epic's history that an antitrust case against them has gotten to this point. It's the next step to a bigger victory for better patient care and more patient control of their medical info. On to discovery!

Today’s announcement by Secretary Kennedy of a ‘crackdown’ on health data blocking suggests the issue is being taken seriously, and there will finally be consequences for those who engage in this practice. Stepped up enforcement on information blocking is long overdue. Without real oversight — and real consequences — there is no incentive for anyone to do better. We know information blocking isn’t a technical glitch. It’s a deliberate tactic by large health IT entities that creates information monopolies and harms patients. Without robust enforcement of the rules on the books, innovation will be stifled and patients and providers will pay the price.
