HMRC launched a new tool yesterday to allow companies establish if a project they have worked on is likely to meet the criteria for R&D tax relief. Whilst I would have liked to see a bit more guidance for each of the questions, maybe a short video explaining some of the concepts, it should hopefully at least make users stop and think about the questions, and go seek additional information, before deciding if their project qualifies, or not. As HMRC can always add more functionality later, it's encouraging they are seeking to assist company owners in making an informed decision, when it comes to the eligibility of their potential R&D claim. https://lnkd.in/eKJBhDxp
I don’t want to sound negative as there is something but this does feel somewhat after the horse has bolted and maybe if this happened 5 years ago then would have been a lot more helpful….
I think GFC3 was brilliant this I am a bit "mweh!" about! I can already see it leading to a 2-tier R&D system. Where small companies are excluded if they haven't completed it for each project and large companies don't even give it the time of day! Can you imagine the lead scientists at GSK, spending 10 minutes for their probably 100's of projects a year completing the form!
Useful tool - but as you highlight, some additional guidance breaking down concepts in the DSIT Guidelines would be key. I prefer some visual representations of the logic involved (Venn diagrams etc). Also, it'll be interesting to see if & how caseworkers point to this tool during enquiries.
Once again, I find myself on the fence. A series of yes/no questions answered by someone who doesn’t necessarily comprehensively understand the rules - and who may be blinkered by a desire to qualify - will almost certainly lead them to a positive answer. The line of “If your answers in the tool are based on your project’s facts and you can clearly support and explain them, we’re unlikely to disagree that it involves R&D activities” did make me smile though…
Its a bit basic but might be a good starting point for the defence against the dark arts - aka 'carelessness' penalties if prepared on a contemporaneous basis for each project.
The end page is a bit absolute - 'The project Project A includes qualifying R&D for tax purposes' I expected it to end with the project 'could' include. It is a nice idea for a tool, though
