You're absolutely right—and this is critical for everyone in multifamily to understand. HUD's May 2024 guidance on AI and the Fair Housing Act established something game-changing: You're liable for discriminatory outcomes from AI systems—even if you're using third-party vendors. Here's the reality that's keeping compliance officers up at night: Most operators don't even know their screening tools use AI Even fewer can explain how these systems actually evaluate applicants Almost none can audit their AI vendors for bias or compliance issues The bottom line: "I didn't know it used AI" or "I don't understand how the algorithm works" won't protect you if your screening tool produces discriminatory outcomes.
