It’s #FiduciaryFriday! Michael Smoots, J.D., AIF®, breaks down the American Airlines ESG case, another example of ERISA litigation where attorneys see the biggest payout. #401k #ESG #ClassAction #FiduciaryFriday
Who wins with these ERISA class action lawsuits? Mostly the lawyers. For example, the attorneys who “prevailed” in that ESG case against American Airlines, have asked the judge to award them approximately $8 million in fees and expenses. Naturally, they requested a service award for the class representative. And that amount with the drumroll… is $15,000. Without political comment on the ESG aspect, I think it’s frighteningly difficult to operate a fully compliant 401k plan, while also maintaining strong fiduciary governance. And your reward is optimistic plaintiff’s attorneys filing a lawsuit, wherein the judge finds a fiduciary breach but No damages, yet you might be on the hook for the attorney fees? It’s #FiduciaryFriday! Michael Smoots, J.D., AIF®, highlights the new 2026 savings limits for defined contribution plans and the upcoming Roth catch-up requirement for higher earners. #401k #SavingLimits #FiduciaryFriday
How much can I save in my defined contribution plan in 2026? $24,500 if your plan is safe harbor or passes testing with an additional $8,000 available for catch-up contributions. And don’t forget, for savers ages 60-63, that catch-up bumps to $11,250. Moreover, persons earning more than $150,000, must make catch-up contributions on a Roth basis in 2026. Each year Prime Capital Retirement produces a helpful chart showing these limits and others like the 415(c) limit ($72,000 in 2026). This year we’ve also developed a guide for complying with that pesky Mandatory Roth requirement. Reach out to one of our professionals to learn more. Thanks to the Internal Revenue Service for quickly publishing these numbers upon returning to work.
