Are you thinking about paying for your employee’s portion of the #PFML Program? To be in state compliance, employers are required to pay for a portion of the Paid Leave Premium. (.22% or .44% depending on your company size)  If you choose to pay any of the employee’s portion of the Paid Leave premium, the amount is treated as taxable wages to the employee and it must be reported on the employee’s W-2 in boxes 1, 3, 5, and 14.  This reporting is not automated in most payroll systems and will likely require manual adjustments by your accountant at year end. We recommend discussing your PFML premium strategy with your accountant or payroll provider to ensure accurate reporting and budgeting for year-end services.

Are you an employer in Minnesota? Here are five key dates to mark on your calendar, with new MN Paid Leave rules right around the corner: ➡ NOW: Set up your Paid Leave Administrator account. If you are in the hospitality or seasonal hospitality industry, send in your request to the state to be exempt. ➡ November 15: Last day to request an Equivalent Plan for 1st quarter of 2026. ➡ December 1: Employees need to be notified of MN Paid Leave by a notice and the workplace poster. Seasonal employees also need to be notified they do not qualify for MN Paid Leave if working in the hospitality industry. ➡ January 1, 2026: Premiums will start being deducted out of employee’s earnings and employer portion will start accruing. ➡ April 30, 2026: the first premium will be due.
