This panel will provide an update on the continued proliferation of consumer class action privacy claims and regulatory enforcements relating to consumer-facing websites and mobile apps. From ad pixels to videos to email tracking, both the underlying technology and creative approaches of the plaintiffs’ bar continue to evolve, as do the challenges surrounding compliance and defending consumer class action litigation, mass arbitration, and regulatory enforcement.

Elizaveta Egorova is an accomplished expert in helping corporate and legal teams navigate and resolve complex business, regulatory, and operational challenges. With deep specialization in regulatory and privacy compliance, particularly in Ad Tech and privacy governance, Ms. Egorova offers a robust expertise in analytics and tracking technology assessments and governance, consent management, privacy impact assessment and automation, digital forensics, and compliance program evaluation and development. She is adept at leveraging data analytics and deploying cutting-edge technology solutions to assess, strengthen, and enhance privacy and compliance frameworks, as well as to support investigations into privacy and compliance breaches. Prior representative engagements include:
– Directed investigation for a healthcare network of six entities facing class actions under HIPAA for alleged PHI/PII disclosure via Meta Pixel, Meta CAPI, and other ad trackers. Analyzed tracker behavior, verified consent signals, and conducted Tag Manager historical review to support counsel and case strategy. Delivered and presented litigation-ready summaries of findings and remediation steps, including Customer Data Platform implementation assessment.
– Oversaw forensic analysis for a Fortune 100 automotive manufacturer facing claims under CIPA. Assessed consent banner behavior, privacy signals, and tracking technologies, validated findings through Adobe Launch tag manager historical review. Delivered litigation-ready reports documenting compliance posture that informed defense strategy.
– Led forensic investigation for a top global asset manager facing allegations under the ECPA and CIPA. Analyzed web and mobile app behavior, tested consent signal integrity, and evaluated cookie-syncing across DSPs and SSPs. Produced and presented counsel-ready findings and remediation recommendations that guided legal strategy.
– Led the development of an Ad Tech governance platform for a Fortune 500 global healthcare company, designed to automate and optimize the governance of analytics and tracking technologies while ensuring robust privacy safeguards and regulatory compliance. This initiative involved conducting stakeholder interviews and gap analyses, collaborating closely with Legal, Compliance, Privacy, and Marketing teams, as well as external marketing agencies. The project also included a comprehensive review and enhancement of existing cookie consent frameworks and Privacy Impact Assessment (PIA) & Data Protection Impact Assessment (DPIA) modules.
– Conducted technical investigations for several major healthcare systems and corporate clients in response to internal investigations and government-led inquiries. Led the analysis and scanning of web assets, delivering comprehensive reports that identified analytics and tracking technologies in need of remediation. Provided both technical and advisory support to clients, which included developing user journey scenarios for asset analysis, collecting and analyzing data, creating Tableau dashboards, conducting due diligence on tracking technologies, and presenting key findings and recommendations.
– Provided strategic advisory and management in guiding the company through a complex response to a Second Request from the Federal Trade Commission (FTC) during a proposed Merger and Acquisition. Oversaw all aspects of the process, offering both technical and advisory support to counsel and the client in navigating intricate data inquiries, managing large-scale document productions, and ensuring full compliance with FTC requirements. Successfully met critical deadlines, enabling the proposed deal to move forward while minimizing regulatory risks.
– Managed data analytics phase of three separate multi-year monitorships of global F500 financial services firms, resulted from separate multibillion settlements with the US Department of Justice. Designed workflow, procedures, analysis and validation logic, conducted quality review, data analytics, financial testing, and visualized data to ensure client’s compliance and adherence to the settlement agreement and contributed to Monitors’ attestation reports to the DOJ .
– Conducted data analytics tests and risk scoring of transactions, identifying transactions in high-risk countries, to government-related entities, and potentially questionable payments associated with governmental projects as part of the US DOJ investigation into FCPA violations by a global manufacturing company.
Ms. Egorova has extensive experience with industry platforms, software and database formats including: Relativity, Microsoft SQL Server, SAP, Oracle SQL Developer, Microsoft Access, Tableau, Power BI, Navex, OneTrust, OSANO, TrustArc, Google Tag Manager, Adobe Analytics, Tealium, FreshPaint, Segment, Google Analytics. She is a native Russian speaker and is fluent in Spanish. Ms. Egorova is a Certified Fraud Examiner (CFE).
Adam Eisler is a Brooklyn based data privacy attorney and technologist. Adam has experience working with clients in a diverse range of industries on proactive and reactive data privacy issues. Prior to joining IAB, Adam worked as a Senior Consultant on data privacy issues, as well as an attorney for a mid-sized law firm and data protection team member for one of the “big four” professional services firms.
Adam received his Juris Doctor (J.D.) from Brooklyn Law School, a Master of Arts degree in Near Eastern and Judaic Studies from Brandeis University, and a Bachelor of Arts in History and Middle Eastern Studies from the University of Connecticut. In his free time, you can find him training in a variety of martial arts, reading, and spending quality time with his partner and two cats.
Eva Yang is experienced in litigation, compliance and enforcement issues regarding consumer products. Eva defends companies in consumer class action litigation matters relating to false advertising, unfair competition, product compliance and privacy issues. Eva also has experience in representing retailers and manufacturers in California Proposition 65 enforcement actions.
Eva was a judicial extern for the Honorable Margaret M. Morrow, former United States District Judge for the Central District of California.
